Prue Wants Murder Charges Dismissed

A lawyer representing a woman charged with killing a popular St. Johnsbury teacher is asking that an aggravated murder charge against her be dismissed.

Marc Eagle filed a motion in Caledonia Superior Court seeking to have the charge dismissed against 34-year-old Patricia Prue. Prue and her husband, 31-year-old Allen Prue, are charged with abducting and killing St. Johnsbury Academy science teacher Melissa Jenkins after luring her from her home in March 2012.

The Caledonian Record reported that Eagle's motion argues that prosecutors don't have enough evidence to prove Prue's guilt beyond a reasonable doubt.

Prue was initially charged with second-degree murder, but the charge was upgraded after five of her fellow inmates provided prosecutors with new information.

The Prues, who have pleaded not guilty, are having separate trials.
