Three members of a jury that sentenced a man to death for the killing of a Vermont supermarket worker are going to have to return to federal court in Burlington to face allegations they held back information about themselves eight years ago and thus denied the defendant the chance for a fair trial.
Lawyers for Donald Fell argue the jurors either misled attorneys during the jury selection process about their backgrounds or engaged in questionable conduct while serving on the jury.
The Burlington Free Press reports that federal Judge William Sessions wants to hold a "limited inquiry" in August.
Fell was sentenced to death in 2005 after being convicted of the 2000 killing of Theresa King, who was abducted when she arrived for work at a Rutland supermarket.
