Vermont's laws on workplace drug testing make it difficult to test employees after they're hired. Now lawmakers are considering a bill expanding an employer's ability to test workers suspected of being under the influence on the job, or if they cause an accident. We're looking at Vermont's existing drug testing laws, the proposed changes and what it means for workers and employers.
St. Albans Rep. Eileen Dickinson, sponsor of H.200, explains how her bill could require employees submit to a drug test if an employer has a "reasonable basis" they're under the influence at work or involved in a workplace accident.
Beth Rattigan, an attorney with the Downs Rachlin Martin law firm that specializes in employment and labor law, discusses Vermont's current laws on drugs testing at work and the current standard of "probable cause."
